Abstract

Lending is one of the legitimate business activities of the commercial banks and rural banks. Both Bank is a business entity channeling funds to the community in the form of credit in addition to other financial institutions. Lenders to provide credit to borrowers always include collateral as security to the bank, because it is basically a risky credit to bad credit. Guarantee is submitted on the basis of trust between the debtor and the creditor, in accordance with Act 42 of 1999 on Fiduciary. The warranty provision based Fiduciary Law is done in order to facilitate the efforts of law for the Bank in the event of bad credit problems. This study is an empirical law in order to determine how the law attempts to resolve bad loans with Bank Syariah Fiduciary BDS in Yogyakarta. The data used in this study is a secondary data obtained from the material library by reading legal materials include primary and secondary legal materials, to complete this study also used primary data by conducting field research through interviews. From the research conducted it can be concluded that in order to deal with nonperforming loans in Islamic banks use the Yogyakarta BDS efforts by way of family settlement without selling goods widened Fiduciary. By providing repayment grace period and interest deduction arrears.
