Abstract

The research was done at the district court Yogyakarta. The choice of it district court based on the fact that the empirical study of medical rehabilitation is already in Yogyakarta court thus considered appropriate if the district court subsequently used as research objects. Yogyakarta in terms of time, cost and energy spent , objects seem very relevant Yogyakarta district court used as a place of research. This research aims (1) to determine and analyze why the substance abuse rehabilitation measures should be applied to medical and not criminal sanctions., (2) To identify and analyze the judge's consideration in determining medical rehabilitation measures for drug addicts. The research method is a kind of normative legal research is a study of secondary data that is a form of research that is based on secondary data from the rule of law as the main data and primary data as supporting data. The discussion of the results of this study that (1) Any drug abusers should be applied to medical rehabilitation rather than imprisonment sanction, because drug abusers are victims who should get their rights as victims, especially the right to rehabilitation, (2) Consideration of judges in implementing rehabilitation measures the drug addict is, the facts revealed in court either by witnesses and defendants and confirmed also by the results of laboratory tests. The facts are preferred is that the perpetrator is the victim of abuse or evidence of narcotics with narcotics is a little worn, and the offender is not a dealer
