Abstract

The rapid development of science and technology in telecommunication field had emerged various kinds of accessibilities to the social society in communication, both orally, in writing or audiovisual. The phenomena of emergence of hand phone become certain readings to the achievement of science and technology in communication field. Hand phone is capable to bring its users into unlimited condition by space and time, the strong wave of acceptance and information sending can be conducted intensely without any meaningful barriers. In addition of the good advantages of its function, in fact communication technology of hand phone leads into negative effects too, by considering that the use of technology has free-value characteristic, various kinds of new crimes also emerges in social community related to the misuse of hand phone. Criminal law that has function as protector and the controller of social order is also tested its relevance and validity in overwhelming this new criminal act in society that is related to the misuse of hand phone.
