Abstract

Letter of credit is an international commerce payment which applied in export import transaction. An importer and exporter usually have some stumble and problem. Those stumble and problem related to the complicated procedure that needs to fulfilled by exporter and importer. Usually related to the required documents which applied with a foreign language that in some case, exporter unable to understand how to fill the documents. Within all the terms and conditions applied on the documents. Thus it could affect the payment process. Data which have been searched was being analyzed in a case study using a statute approach. Which related to the problems issue towards the implementation of UCP 600 enacted to replace UCP 500 as guidance to the export import payment process using letter of credit. UCP 500 compared with rule in UCP 600 more substantial compliance primary than strict compliance, which mean an easier way for the exporter to take L/C from Issuing Bank opener to the acceptance of L/C. Issuing Bank must concern about criteria of applicant as credit opener. When there are discrepancy, then the Negotiating Bank must collect the payment on Issuing Bank.
