Abstract
Long term of usaging phsycotropic without supervision and limitation will cause bad affect, such as addiction or even worse physical or mental disparity for the user, or in the worst case is death. Phsycotropic is a kind of medicine that use in the medicaton of mental patient in certain dose, which is written in ACT number 5 year of 1997 and also defined by medic. That's why the writter comes up with the two problems of law, has the doctor gave the right limitation of phsycotropic for the mental patient? And what was the punishment for the doctor whos did the deviation in usaging a phsycotropic for medication of mental patient. It has purpose to find out the limitation that should be obey by the doctor in giving of medicine kind of phsycotropic. And also to find out the punishment for the doctor if doctor made the deviation in usaging a phsycotropic for madication of mental patient. Writter use the normatif research method whis is focussed in norm (Law in the book), where secondary data is the main data. From the research, it can be conclude that the limitation of giving a phsycotropic in medication is more detail, which is depend on the condition of the patient and needs. And the limitation according to ACT number 5 year of 1997, as in chapter 13, 14 sentence (1), (2), (3), (4), (5), and (6). The handout of phsycotropic is for medication for patient whose need a medicine kind of phsycotropic and for science. And also the punishment for the doctor who commit a deviation are imprisonment for 5 year and fine about 100.000.000 rupiah, doctor also imposed ethics sanction
