Abstract

The purpose of this research is to find out that the publication for the children and victims of the criminal act is for the benefit of those children. Beside that, the purpose of this research is also to find out the penalty for the publisher of those children as the executors and victims of those criminal acts. The method which is applied here is normative law research that is reviewing the values of the valid law by using the foundation of law also the relevant theories and focusing on the value of the positive law like law regulation. The type of this law research is conducted through the process of description, systematic, analysis, interpretation, and judging the positive law, which result in deduction process. From this research a conclusion is reached that for the best benefit of those children according to the Law number 23/2002 concerning the children protection, children publication as the executor and victim of criminal act is prohibited to protect their identity. Yet, in practice this children publication still happens either openly or in disguise. If the publisher still released this publication, the publisher will be given prison and fine penalty because neglecting the children right. This penalty was ruled based on Law number 32/2002 about Publishing. KPI also will give administration penalty to this publisher.
