Abstract
The title of this legal writing is rehabilitation of the children in the penitentiary based on children rights. The purpose of this research is to know rehabilitation of the children in the penitentiary based on children rights. The type of research is used normative legal research. The secondary legal materials are used of some legal views from books and website and the primer materials are the regulations in Indonesia within deductive thought process. Based on research data showed that children on rehabilitation in Sleman Penitentiary Class IIB has not been given fully their rights to have the facilities and services as it could be found in children penitentiary. However they provide a time for the family to keep gives their care and guidance for their children in order to keep them grows and develops naturally while in the penitentiary.
