Abstract
The problem of my research was concerned about the Role of Governmental Apparatus in Overwhelming the Custom Marriage “Kawin Ukur” in Waropen Atas Subdistrict, Waropen Regency, Papua Province. The marriage was the human rights and should be ruled in national law of marriage ruling on the conditions and the validity of marriage in order give legal force. The children were the grants from God and behalf as the young generation as of state ad human resources to national development. Thus, human rights should be ruled in the Law on children protection and in the implementation it was very needed the role of governmental apparatus. The shape of marriage which become the community’s habits of Baudi ethnic was the custom marriage “Kawin Ukur”, however in the implementation it was very opposed to the national law of marriage because it is not appropriate with the condition and the validity of marriage as has been ruled in the law of marriage and also in the shape of marriage it has eliminated the children’s right as has been ruled in the law of children protection. The custom of Baudi ethnic in custom marriage “Kawin Ukur” to take the daughter as a wife while she was approximately 4 to 8 years, if that marriage has been stated as valid by the community of Baudi ethnic, thus the husband will take his wife of which still very young to live together with the his family. Before the husband conducted any sexual intercourse with his wife, he will measure the width of his wife’s vagina by using his finger to certain the ability of his wife before conduct any real sexual intercourse.
