Abstract

The authority of Corruption Eliminating Commission ( KPK ), and the Attorney in investigating the case of corruption in State-Owed Corporation (BUMN) up to now has not been ruled firmly in the Law Number 30 of 2002 on KPK or the Law number 16 of 2004 on Attorney of Republic of Indonesia. The Law concerning on the eliminating of criminal action of corruption ( The Law number 20 of 2001 states that the state financial also comprises of the wealth, in State-Owed Corporation. In another hand, some part of the Law Number 19 of 2003 on State-Owed Corporation state that the state financial which included in State-Owed Corporation do not included in the state financial. By this research, it is hope could find a similar meaning concerning on the concept of state financial which existing in the State-Owed Corporation, thus there is a clearance on the meaning of state financial and also the task and the authority of KPK and the Attorney in the effort of legal enforcement and the investigating of a criminal action of corruption in State-Owed Corporation. The follow up is harmonized into the regulations relating to the task and authority of KPK and the Attorney in investigating and enforcing the law on the criminal action of corruption in Indonesian State-Owed Corporation.
