Abstract

This Research is mainly talked about Role and existence forensic cyber in the conviction law of the cyber crime in Indonesia. In here there are two problems that are being analyzed. The first problem is talking about the role of the forensic cyber in the conviction process of the cyber crime and the second problem is about the existence of the forensic cyber in the Indonesian Legal System. The type of this research is the normative research with the research method of gathering the data by reading and taking important notes from the books, documents, literature, legal documents and interview. In here there are being founded two results, the first one is that the forensic cyber has important role to indentify the digital evidence and analyzing the evidence so that this evidence could be used as the evidence in the court. The second result is in the case of cyber crime, the existence of the forensic cyber could stand independent as the evidence in the electronic documents but couldn’t stand alone in the common criminal case because in this case the existence of the forensic cyber categorized as the evidence that lead into the crime conviction
