Abstract

The existence of Finance Service Authorities (OJK) gets OJK in microprudential monitoring to be transferred from Bank of Indonesia (BI) to OJK so that it brings several problems in the transition process. This was about the problem of Authority Transfer on Banking Monitoring from BI to OJK. The research formulation problem is how are the juridical aspects of authority transfer on banking monitoring from BI to OJK. This was a normative legal research. The normative legal research was also a doctrinal legal research. The statue approach is conducted by compiling all the laws and a number of related regulations. The problem conclusion of OJK is the coordination of OJK in micro-prudential monitoring information scope can be disrupted because the facility and medium and infrastructure still limited, the member of Board of Commissioner on Ex- Officio is Vice-Ministry position and it is not structural position or functional position, but it is only political position so that this could disrupting independence of OJK, human resource, incomplete facility and indeterminacy of document and asset transferred from BI to OJK and transition period during 1 year is not effective, and budgetary fund from National Budgeting (APBN) is disrupting independence and interest collision and the retribution implemented towards Banking Finance Institution is too high from its percentage.
