Abstract

This research was conducted to find out the criminological aspect of abortion crime carried out in Imogiri a sub urban area of Bantul, in the district of Bantul State Court. This research used normative method. The result showed that there were two legal cases on the same abortion crime which had been processed in Bantul State Court. In the first legal case, the accused was Kusnyah, a sixth month pregnant woman who asked Mrs. Kasan Ngabeni, a massage shaman to abort her unwanted pregnancy. Therefore Mrs. Kasan Ngabeni became the accused in the second legal case. From the criminological perspective, the deviating behaviour of Kusnyah was based on trial and error act to make her release from unendured burden of the unwanted pregnancy. Whereas the deviating behaviour of Mrs. Kasan Ngabeni could be associated with the economic reason. Both were sentenced 2 months imprisonment respectively by the court. From these phenomena the conclusion that could be drawn is that, the quick and smart reaction of the society is the prominent factor in the process of criminal justice system. Therefore it is recommended that the society should be aware of crimes committed in their surroundings in order to give quick information to the police.
