Abstract

This research was conducted to find out the similarities and differences between Law No.13, 2006 on Protection of Witness and Victim in prevailing Indonesian Penal Code and laws of the same kind in the Penal Codes of some other countries such as Netherlands, New Zealand and some states of USA like Arizona, Connecticut and California. This research used normative and comparative methods. The result research showed that there are similarities and differences between Law No.13, 2006 on Protection of Witness and Victim and laws of the same kind in the Penal Codes of some other countries mentioned above. The different things found out in this research such as fund collection for victims of violence crimes in the Netherlands are based not only on juridical but also philosophical and legal policy considerations as seen in the Netherland law “Wet Voorlopige Schanderfons geweldmisdrijven”, and ideas on alternative settlement of cases dealing with victims of violence crimes as practised in New Zealand known as family group conferences by restorative justice process, and plea conference proposed in some states of USA are important inputs for us to consider as new materials in the effort to revise Law No.13, 2006 on Protection of Witness and Victim in Indonesia.
