Abstract

Traveler’s cheque is one of negotiable instruments that exist in our economic system. Traveler’s cheque is a part of banking services that usually used for travel purpose. Recently Traveler’s cheque not just used for travel purpose, but also for other purposes, such as for gift, or even for an illegal purpose like bribery or gratification. Indonesia needs to formulate a regulation governing the Traveler’s cheque to avoid the using of Traveler’s cheque in an illegal transaction. To know what kind of regulation that we need to formulate, we also need to know about nature of Traveler’s cheque. This research is intended to describe about legal aspect and legal problems that related to the using of Traveler’s cheque and also about the practical and theoretical weaknesses. This research is normative research, made by reviewing/analyzing secondary data in the form of legal materials, especially primary legal materials and secondary legal materials to understand the law as a set of rules of norms in the system of positive law governing human life. The result of this research is Indonesia needs to formulate a specific regulation about Traveler’s cheque, because there are many weaknesses related to Traveler’s cheque
