Abstract

The aim of this research paper is to find the legality of electronic money exchanger in indonesia and its legal stand in electronic money trade dispute. The method in conducting this research paper is normative legal research using conceptual approach. The main data of this research is indonesian regulation which is regulate all about electronic money, included foreign money exchanger that regulated by Bank Of Indonesia. In drawing conclusion, this research paper uses deductive reasoning method, based on a general conclusion about electronic money and exchanger that found on all regulated that related to reach a particular institution named electronic money exchanger. Electronic money exchanger nowhere found on all regulation in Indonesia. The money exchange concept can found on Regulation Of Bank Indonesia Number : 12/22/PBI/2010 About Foreign Exchanger, but this concept can not be applied to electronic money exchange because the system is different. Therefore, the result of this research, Bank Indonesia as a Central Bank in Indonesia have to make a new regulation to regulate electronic money exchanger and their activity so if there is an electronic money trade dispute, this regulation can be used as source of law by the judge as well as to protect all party who related by Indonesian government.
