Abstract

Rank in the Indonesian Forced Armed are the ones to determine the grouping consisting of enlisted soldiers, NCO and officer. Both the Army, Navy, and Air Force rank of validity given the authority and responsibility in the military hierarchy. Rank higher military advocate of the judges in the military justice became public concerns regarding the independence of judges to examine and decide a case. This research aims to determine whether there is an influence rank higher legal counsel of the judges on the independence of judges in examining and deciding cases in military courts . Military advocate rank higher than the judges did not affect the independence of judges to examine and decide a case, it can be seen from the quality of the decision of the judges when the hearing Cebongan prisoners accused of murder to be tried in the Military Court II - 11 Yogyakarta. The method used in this study is a normative legal research is research that focuses on the positive legal norms in the form of legislation that were examined both vertically and horizontally, which is reviewing the act as well as interviews with sources related to rank the influence military advocate more height of the judges on the independence of judges in examining and deciding cases in military courts .
