Abstract

In this research, the authors discuss the application of Subjective Conditions For Basic Detention Against Suspect By Police Investigators. This research is motivated by the investigators in the use of subjective terms to determine whether a suspect should be detained or not detained, because it depends on the conditions of detention and the situati on investigator. The research was conducted to address issue is How the application of subjective terms as the basis for the detention of suspects by police investigators. The purpose of this study is to investigate the application of subjective terms as basic detention and obstacles encountered in the implementation of such subjective terms. This research is a normative law. Data were analyzed qualitatively and methods of deductive reasoning used is that the opposite of common knowledge and is used to assess a particular incident. The results of this research is, investigators in applying a subjective requirement as a basis for detention if the objective requirements have been fulfilled, the suspect was not cooperative, there is no guarantee of the family / legal representative of the suspect.
