Abstract

Corruption is detrimental to the country financial, to restore the state’s financial losses the defendant must be punished the criminal sanctions payment of compensation, so the financial losses can be restored. The purpose of this research are to find out the answer about how the existence the regulatory of criminal sanctions payment of compensationin the response the corrupiton and how the implementation of criminal sanctions payment of compensation in the case of corruption in Indonesian. The type of this research was a normative legal research, foccused on the positive legal norms to form a regulation about corruption. From these results of this research, 1) the existence of regulatory criminal sanctions payment of compensationalready strong and clear position in the system of positive law in Indonesian. 2) The implementation criminal sanctions payment of compensation in the cases of corruption, doesn’t have a relevant similarity calculation method, the process of proving at the court be very important and the mild subsidiary punishment always make the defendant not to pay the criminal sanctions payment of compensation
