Abstract

The purpose from the research that entitled “The Existence of Chapter 302 KUHP against Criminal Act of Animal Cruelty in Indonesia” is for acquiring data about the existence of Chapter 302 KUHP against animal cruelty. Also everything that underlying for defends the chapter 302 KUHP in Indonesia. This kind of research is using normative law research methods, which is research that focusing on the norms of positive law by using secondary data as the main data and primary data as the supporting data. Primary data itself consist of KUHP, UU No. 18 Year of 2009 about Animal Husbandry and animals health. Whereas, for the secondary data based on the books of law literature, and the opinion from the literature, website, documents, newspaper, and the internet. The result from the research that will do: Actually, the existence of Section 302 KUHP in Indonesia is really needed considering the high quantities about animal cruelty in Indonesia. But, the fine and punishment that implemented on Section 302 KUHP is minor in importance and not appropriate with the phenomenon that happens in Indonesia these days because still using Hindia Belanda’s currency. Considering that situation, it needs to do the currency convert right now. And also, the lack of awareness from the society about the ways we should treat the animals well.
