Abstract

The point of this research is to know about the idea and the background how the Preliminary Inspection Judges Institution being formed based on RUU KUHP. In addition, this research wants to figure out the expectations and the challenges towards the existence of Preliminary Inspection Judges Institution in Indonesia’s Criminal Justice System in the future. To be seen from the types of research, this research uses the normative research methodology by assessing some theories which are related to the norms which are applied in Indonesia. The data which are used in this research are primary data and secondary data. This data research is collected by interviewing and it has been analyzed in qualitative and quantitative, and it is written in analysis descriptive. The result of this research shows that the prospect of the existence of preliminary inspection judges institution in criminal justice system in Indonesia is background by some International conventions related to the protection of human rights (HAM). In addition, the preliminary inspection judges as a new institution in RUU KUHP has some challenges and expectations to be faced related to geographic aspects of Indonesia which has lots of archipelagos, the fulfillment of judges rights, and the law effort for the decision of Preliminary Inspection Judges
