Abstract
To compete in a global economic challenges. PT. Trakindo Utama Balikpapan should be more efficient and effective to manage their own businesses. to employ an outsource worker could be the answer of managing a business. PT. Trakindo Utama Balikpapan hire some outsource driver from KOKAPURA to help them on a transportation affair. An employer shall concern about employees right. In 2013 4 of 13 driver overtime claim was in arrears by the user. one of the driver overtime claim was in arrears for 6 months. From the above background. It is in writing of this essay presented one main issue, namely how to fulfill PT. Trakindo Utama Balikpapan driver’s overtime claim? This research is empiric research. Made by using primary data as a main data, secondary data also needed in the form of legal materials. The conclusions of the research indicate that the PT Trakindo Utama Balikpapapan shall pay the driver salary otherwise the labor department shall enforce the company to pay the driver sallary with additional charge of fines.
