Abstract

This research aims to determine the extent of consumer protection in Indonesia, especially in the use of electronic transactions through the website private transactions. This experiment also examines consumer protection by certification body Reliability and step by step what to do to better provide protection to consumers in using private website for public services. The research is normative legal research using the approach of legislation and legal concept analysis approach. Legal materials used are the primary legal materials in the form of legislation, secondary law in the form of literature related to the problem. The entire legal materials were collected by topic issues that have been formulated and analyzed by descriptive and evaluative. Based on the results of a study of these problems, the form of legal regulation on Consumer Protection in Electronic Transactions especially using the services of private websites in Indonesia in terms of Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektroni (ITE) and Peraturan Pemerintah Nomor. 82 tahun 2012 tetang Penyelenggaran Sistem dan Transaksi Elektronik (PSTE) remains unclear as Lembaga Sertifikasi Keandalan (LSK) In addition, the ITE Law, there are several conflicting rules. However, if the terms of consumer protection in general in Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen , most of the consumer protection in conventional and Electronic transactions are the same and can be used. But legal protection for consumers in the virtual world is very necessary to ensure equality between businesses and consumers. Therefore LSK in the country should immediately be formed, with Accordingly existing rules may be functioning and consumers are better protected. Currently the legal protection given to consumers in general, preventive and repressive through litigation can be done by filing a civil suit and criminal sanctions based on UU ITE Through non-litigation can be resolved by alternative dispute resolution through one of Arbitration
