Abstract

The defamation for KUHP is definf as an attack of someone’s dignity with an accusing or with lettering or pictures shared, showed or posters. The defamation for UU ITE is defind as something for a transmits and/or distribute the electronic information which is contained the defamation. Consider the judge to decide the case of defamation by a social media, should notice the things, like: see the element of insent, motive and background, subject and object, media used, the social impact that appear in sociality. Obstade and constraits for the judge in decide the care of a defamation is in deciden determined locus delicti. This can be a serious problem and can be a obstacle and constraits for the judge in handling the case of defamation by a social media.
