Abstract

Every people has the right to get a job and decent livelihood, including persons with disabilities. Persons with disabilities are a part of a community that has right to be fulfilled, protected, and championed. The title of this research is: “Implementation of provincial (local) regulation of Yogyakarta Number 4 in 2012 to the workers with disabilities at PT Yogya Presisi Tehnikatama Industri”. This research discussed about protection and fulfillment the rights of workers with disabilities in PT Yogya Presisi Tehnikatama Industri. The purpose of this research is to determine and analyze about the implementation of provincial (local) regulation of Yogyakarta Number 4 in 2012 to workers with disabilities in PT Yogya Presisi Tehnikatama Industri and to determine and analyze the constraints PT Yogya Presisi Tehnikatama Industri implement that provincial (local) regulation. The method of this research is empirical legal research that focus on the behavior of law community. As the main source is interview with speaker, respondent, and study of literature. The result of this research is PT Yogya Presisi Tehnikatama Industri already employ workers with disabilities. The results showed that PT Yogya Presisi Tehnikatama Industri already implementing some of the provisions that set out in the Provincial (Local) Regulation of Yogyakarta (DIY) No. 4 of 2012 is already hiring workers with disabilities that is sufficient to meet the quota 1 worker with disabilities in every 100 workers. However, PT Yogya Presisi Tehnikatama Industri does not provide optimal accessibility for workers with disabilities, and has not open a special job for workers with disabilities. So far the recruitment based on needs, but there are possibilities to recrut workers with disabilities if the type of the job is not a barrier to prospective employees stay productive.
