Abstract

Consumer is one of the important elements in economy, besides producer and product themselves. They are related each other. The producer needs the consumer in order that commodity and/or service can be sold completely for smoothing the economy, while the consumer needs them to fulfill their life needs. In fact, there are so many cases appear due to unresponsive producers to their consumers. The consumers often get minimal service from producers who producing and distributing food which contains of dangerous substances like borax, formalin, etc. Those substances are very dangerous for human body. Because the society doesn’t know it yet, government’s role is needed here. Writer here tries to analyze about the consumer protection of dangerous-substances food, based on the positive law in Indonesia; the law Number Eight Years 1999 about Consumer Protection. The research uses the normative law research by observing literature materials and interviewing some important informants. The research will analyze about the responsibilty of the unresponsive producers according to the law Number Eight Years 1999 and the certain laws set by Board of Medicine and Food Controller (BPOM), Health Service, Industry Service, and Yogyakarta Consumer Institution (LKY), and also the efforts to overcome the distribution. The conclusion of these analyses is the responsibility of the producers is getting sanctions such as being prisoner, paying fine or retribution, getting warning, withdrawal the exertion permission and even bring along a court. While in overcoming the food distribution BPOM, Health Service, Industry Service, and LKY are giving directive counseling, monitoring and inspection to society, producers and even consumers.
