Abstract
The title of this law research is the legal aspect of the protection of forests and indigenous people in Western Kutai Regency of East Kalimantan. Forests destruction is more alarming and the rights of indigenous peoples is no longer guaranteed for violations committed by coal mining, thus needed legislation and responsibility of the government in implementing the rules relating to the protection of forests and indigenous people in Western Kutai. The purpose of writing this law is to specify the legal aspects of forests protection and indigenous peoples towards the coal mining and find out what are the obstacles and solutions, the author hope to contribute to the government, society, and the development of legal science. The method used in this research is the study of empirical legal research and sampling using purposive sampling. Based on the results of research conducted by the authors, it was found that the legal aspects of the protection of forests and indigenous people in Western Kutai Regency in practice is still less than the maximum and inconsistent, this is due to the overlap between the regulations made by the central government and local government, lack of commitment of local governments in fulfilling their duties to protect the forests and indigenous peoples, and the lack of participation by indigenous peoples.
