Abstract

The title of legal writing is the right of use of foreigner on an Indonesian’s ownership right of land to own a house after the implementation of law No. 5/1960 of Basic Agrarian Law (UUPA Indonesian version) in conjunction with Government Regulation Number 41/1996 and Ministerial Regulation Number 7/1996 in South Kuta District, Badung Regency, Bali Province. The legal case was how foreigner gained the right of use on an Indonesian’s ownership right of land to own a house after the implementation of law No. 5/1960 of Basic Agrarian Law (UUPA Indonesian version) in conjunction Governmental Regulation Number 41/1996 and Ministerial Regulation Number 7/1996 in Bali Province. The purpose of this research was to know how a foreigner gained the right of use on the land of property right for living house after the enforcement of UUPA junction Governmental Regulation Number 41/1996 and PMNA/KBPN Number 7/1996 in Bali Province. The data was analyzed qualitatively which was conducted by comprehending and arranging any data which has been collected systematically in order to gained a description on the condition understudied. The conclusion was drawn by using inductive reasoning method i.e. the process of consideration initiated from specific knowledge into the general knowledge. Based on the research in South Kuta District, Badung Regency, Bali Province it could be concluded that almost all respondents gained right of use on an Indonesian’s ownership right of land to own a house has been appropriate with law No. 5/1960 of Basic Agrarian Law (UUPA Indonesia version) in conjunction Governmental Regulation Number 41/1996 and Ministerial Regulation Number 7/1996. However along with the proceeding of time there are respondents which do not fulfil any conditions as the subject of right of use on the land of property right
