Abstract

Negligence process according to the law is crossed with the negligence of profession of doctor according to the ethic of doctor, where both of them are based to the standard of medical profession. Thus it is often founded out the cases in health field that place the patient in the weak position. From this background, thus this research tried to formulated a case, that is "How the responsibility of doctor to the negligence in handling the legal abortion". The aim of this research was for knowing how the responsibility of doctor for his negligence in handling the legal abortion. The kind of this research used is literary study. It is the research done by collecting data that fit with the material. In this data analyzing, the method used by the writer is qualitative analysis. That was analyzing and understanding and also used the deductive method. That was took the conclusion from the common facts to the specified conclusion by used the consideration or ratio. The result of this research could be concluded that the responsibility of doctor for his negligence in handling the legal abortion that are the substitution of detriment. The responsibility of doctor in this case was based to the fault as the result unfulfilling the duty that had been ruled in article 1243 KUHPerdata. Beside that, the responsibility of doctor could also was the illegal action. Because beside the negligence, there conclude the unawareness that based to the article 1365 KUHPerdata
