Abstract

The tittle of this legal writing concerns on Qualification Narcotic Abuse in Legal Enforcement Process. The purpose of this legal writing was to know the symptoms and the intensity of the qualified dealers and narcotic abuse in a category abusers, addicts and victims of narcotic abuse with a size comparison information based on a parameter using medical instruments in a legal nature for the individual concerned abusers. The method of this research in legal writing was normative legal research, i.e, a research of which is focused on positive legal norm by shape regulations and in this research it needs secondary data as main data. The result of this research is the application of the qualification of the offenses in narcotic abuse since at this stage of the investigation process in the Police, the stage of prosecution by the Prosecutor and the Judge's decision stage. That in qualifying narcotic abuse is still no common ground between police investigators, the public prosecutor and the judge. The difference is due to the Investigator and Prosecutor General in implementing the punishment always refer to the chapter against the defendant as stipulated in the Legal on Narcotics. However, unlike the case with the judge who has the conviction and the facts in the trial. The first level of the judges have argued referring to the indictment the prosecutor in examining and prosecuting a criminal case of narcotics.
