Abstract

The child is a desire of every family, the love that is given can make the children feel the attention and be extroverted to their family. A good environment also affect to the child development, because they are a good copier. The crime that commited by a child can make their mentality easily shaken, because they have not been think well of everything that they are doing. A child that convicted of a criminal act must be protected and checked by the criminal justice system of children. The paper aims to find whether the settlement of criminal cases the child is done with the restorative justice approach. In addition the model is suitable to be applied to the settlement of criminal cases of children with restorative justice approach. According to the scope of the study is on the disciplines of law, this is a part of a normative legal research. Sources of data is a secondary data that consists of primary legal, that is basic laws and secondary legal materials obtained from books, training and internet. By data analyzing of the primary legal materials in the form of basic laws and secondary legal materials. Based on the description and analysis can be concluded that the resolution of criminal cases the child is done with a restorative justice approach. Besides an appropriate model to be applied in the settlement of criminal cases children are models of familly group conferencing.
