Abstract

This legal research entitled determination of the suspect based on evidence of commencement sufficient to uncover the of criminal acts of murder. Determination of suspects by the police should be based on the rule of law, starting from evidence of the beginning , evidence of commencement sufficient, enough evidence, so that the determination of a suspect by the police is not solely bertendensi to make someone into a suspect in a criminal act of murder. The purpose of this research is to obtain data about the determination of a suspect in criminal acts of murder and to obtain data about the constraints experienced by police in determiningin of a suspect in criminal acts of murder. This legal research using this type of normative legal research basing on the norms of positive law, the study of the literature and conducting interviews in RESKRIMUM POLDA Yogyakarta. Methods of data analysis used is dedukif analysis, a method that uses a qualitative measure, comparing the primary and secondary data, described and selected in accordance with the topic of the issue. The result of the research was determination of suspects by police based evidence of commencement sufficient that of the report and a minimum of 2 (two) instrument of evidence valid in accordance with article 184 CRIMINAL PROCEDURE CODE in order to do degree case to establish the establishment of someone as a suspect a criminal act of murder. As for the obstacles faced by police was the lack of evidence found.
