Abstract

Land is the basic human right which is important value, strategic and special for indigenous peoples in Indonesia. Indigenous peoples in Indonesia have particular rights, including the land rights, which is termed as customary or communal rights. Communal lands of the indigenous peoples in the Nagekeo Regency, often generates an importance dispute, such as the communal land of the Lape indigenous peoples. Lembaga Persekutuan Adat (LPA) Lape as a traditional institution of the Lape indigenous peoples has an important role in the dispute resolution of Lape communal land in accordance with its duties and functions. Based on that background, the authors take the title of a mini thesis, “Duties and Functions of Lembaga Persekutuan Adat Lape (LPA) Lape in Dispute Resolution of Communal Land of the Lape Indigenous Peoples to Fulfil the Rule of Law in Nagekeo Regency-Flores-NTT Province (The Case Study of Land Dispute of Nagekeo Parliament Office). Legal issues on this thesis is, How the duties and functions of Lembaga Persekutuan Adat (LPA) in dispute resolution of Communal Land of the Lape Indigenous Peoples? The second issues is, Are the duties and functions of Lembaga Persekutuan Adat (LPA) Lape in dispute resolution have fulfiled the rule of law in the Nagekeo Regency- Flores-NTT Province? Law research on this thesis is normative law research focuses on the positive legal norms and requires secondary data (material law) as the primary data. The methods of data collection in the thesis uses literature study with data analysis method in the form of a qualitative method. The result oflegal research concluded that the duties and functions of Lembaga Persekutuan Adat Lape (LPA) Lape has been implemented on non-litigation and litigation resolution methods. The duties and functions of the Lembaga Persekutuan Adat (LPA) Lape have fulfiled the rule of law on the land which is the object of the dispute.
