Abstract

The case of narcotic in Indonesia State seemly has become very important problem which has not been solved up yet up to now. In this legal research, it aimed to study and find on how the practice of overwhelming of narcotic usage in the legal area of Polwil Kedu Magelang especially to study on how the lega; enforcement which is enforced to the user or narcotic addicted. Method of research which used in this research is normative legal research method. This method is legal research which focused on norm (law in the book) and this research used secondary data as the main data. This normative research is conducted by studying the case study which focuses the research in this legal research which happen in an institution or instance. From the result of this research, in practice the part of policy has not beeb fulfilled yet the enforcement of regulation which is valid on how it is obligated to the user or addicted of narcotic to be rehabiliated and not to be judged by criminal punushment, by the reason of rehabilitation process or the medicating is not likely to be conducted in socialization institution or LP. Thus, it is better to the user or the addited of narcotic not to be judged by criminal punishment. However they should be given any medicating therapy, or rehabilitation to the curing of either physical or mental condition because the user or the addicted of narcotic is the victim of narcotic crimes.
