Abstract

This legal writing entitled “The Implementation of Validity on Determination of Nine Dashed Line South China Sea by the Republic of China in accordance with United Nations Conventions On The Law Of The Sea 1982 (UNCLOS III). The problem started when the Republic of China establishes Nine Dashed Line over the Pratas Island, Paracel Island, Spratly Island, and Macclesfield Island not approved by some member of ASEAN countries, including the Philippines, Vietnam, Brunei Darussalam, and Malaysia. This is a legal research that using normative research methods, by reviewing related theories as well as the prevailing norms. Primary data, secondary and tertiary data are used in this legal writing. The data collecting by through interviews and analyzed qualitatively, then written in descriptive analysis. Based on literatures and interview, the researcher found the fact that stipulation of Nine Dashed Line over the South China Sea declared invalid according to United Nations On The Law Of The Sea 1982 (UNCLOS III). The determination of Nine Dashed Line by the Republic of China was made unilaterally without notice to the other countries bordering the Republic of China and the countries which also claims the South China Sea.
