Abstract
The title of this research is : “The Responsibility of Receiving State About the Sexual Offence Performed by Diplomatic agent to Citizens on The Receiving State (A Case Study Sexual Violence by Diplomatic Agent Netherland About Citizenz on The Indonesia) The purpose of this research is to understand the responsibility of Indonesia as receiving state to the sexual violenceperformed by Diplomatic agent to citizens of receiving state. The Diplomatic agent has an inviolability and immunity, that means the Diplomatic agent has a protected right from legitimacy of receiving state and has an immune from jurisdictions of receiving state both of criminal law and civil law. This is a normative legal research, so the data analysis method which used is deductive. The conclusion of this research is the receiving state must take persona nongrata action and ask the sending state to fire, recall the Diplomatic agent to carry out a lawsuit in front of the court his country. The suggestion from the writer it is important to control the relationship both of countries in bilateral agreement especially the matters related with the manner of Diplomatic agent in running his duty as the representative of sending state. This is purposed to make a transparency in order to take an action to abuse of diplomacy immune, both of receiving state and sending state must be objective and fairly in handling this sexual violence that occurs and take an action to the Diplomatic agent who makes violation.
