Abstract

ABSTRACT Naughty children are not to be punished, but given the guidances. The children who do criminal acts in the prison criminal threatened under seven years old and who are not in a repetition, should be pursued by restorative justice approach. The objective of this research is to know the needs of restorative justice aprroach and determine the forms of restorative justice approach in order to resolving any violences in educational institution. The model of this researh is normative law research, which it means focuson to positive law norm, like shape of legal systemation by doing, description, systematic, analisis, interpretation, and evaluate positive law, vertically and horizontally for the problem that concerned about implementation restorative justice approach is used to solving any violences in the educational institution . The results are shown that restorative justice approach is used to solving any violences in the educational institution, because of the several reasons; first, normally the children need education, second, the children are easier to be lead compared to the older people, third, the cases are finished earlier, and the victims’ interest could be fulfilled. The form of restorative justice approach used is penal mediation.
