Abstract
The worst impact of the armed conflict has been shadowed on the child. Unfortunately, this impact happened to child in Yemen. One party in the Yemen war used child as a soldier. This act is totally against the laws of war. Especially Yemen has ratified the Geneva Conventions 1949, the Additional Protocols of the Geneva Conventions 1977, the Convention on the Rights of the Child 1989, the Additional Protocol to the Convention on the Rights of the Child Related Child Involvement In Armed Conflict 2002. In this research, specific discusses about child soldiers in armed conflict in Yemen. The purpose of this research is to know the form of legal protection against child soldier. It’s a normative legal research; a research to examine the implementation of positive law. Child soldier in armed conflict in Yemen are not included as legitimate combatants under the International Humanitarian Law, because the Geneva Conventions set that basically children are belong to the civilian groups, therefore they must be protected. In the case of the child had already forced to be a soldier then when he/she was captured by the opposing party, the child soldier must be protected by his/her rights as a child and not as a prisoner of war
