Abstract

The tittle of this undergraduate thesis is the Disparity of judge's decision against narcotic abuse first class case for itself. The main problem in this thesis is how the judge's concideration to adjudicate the case of narcotic abuse first class until the disparity happen. The aim of this study is to get the data which is will be processed and analayzed in order to answer the problem of disparity judge's decicion on the narcotic abuse first class case in District Court of Sleman. The method of this study is normative method with literature and interview study. As a result, researcher found the two factors that affecting the judge in order to make a decision. First, there is an assessment of defendant or reverse. Second, the judge's point of view in judging the fact of the trial and judge's consideration in the trial.
