Abstract

This thesis is about legal protection over policy rules releasing (administration law perspective). This thesis aimed to understand the position of policy rule itself in Indonesia legislation hierarchy, how the legal protection over policy rule releasing works, which league authorizes to examine the policy rule itself, obstacles on giving the protection, and efforts to solve the obstacles. This research is a juridical normative yet theoretical mapping research, which is on doing the research, researcher examined the regulations, theories, and experts opinion that are related to this thesis. As the result, this research did not find any proves that policy rules is any part of Indonesian legislation hierarchy according to Act Number 10, 2004 which was withdrawn and replaced with Act Number 12, 2011. Thus, policy rule examination by Supreme Court is not proper to do. But policy rule examination by Administration Court using interpretation approach of Act Number 30, 2014 for Government Administration.
