Abstract

The phenomenon about the use of mercenary in armed conflict has been known internationally for a long time. To overcome this phenomenon, the treaties about mercenaries have been made. In its development, the regulation about mercenaries caused pro and contra, and created a legal loophole for some countries to use mercenaries in an armed conflict. This thesis wrote about law enforcement for the countries that used mercenaries in armed conflict, sanctions and state responsibilities for the countries who broke the International Humanitarian Law. The methods in this thesis used normative research. The data was collected by the use of library research and interview. The data was processed by deductive method. The conclusion from this thesis are mercenaries used in armed conflict is illegal. Enforcement procedures for the violation of International Humanitarian Law can be implemented through International Court of Justice or general law enforcement. Therefore, the regulation about illegality of mercenaries should be regulated clearly.
