Abstract

The policy of Indonesia Government related to the equiation of price of fuel and oil or “one price of fuel and oil” is one of priority program of Indonesian Government which intended to create social justice for all Indonesian citizen. Moreover this policy also meant to revitalized the mandate of Indonesian constitution of 1945 article 33. On the other side, this policy also cause great worry related to peformence of PT. Pertamina (Persero) and the potential of loss of this company as responsible company of this programe. Furthermore it is also contradict with state-owned enterprises princilpe in article 2, paragraph 1 alphabet b contitution number 19 of 2003 about state-owned enterprises. Through yuridical analysis, this essay while show that the policy of the equiation of price of fuel and oil or “one price of fuel and oil” does not contradict with state-owned entreprises principle, event it will direct Pertamina to do its responsibility in accordance with the mandate of Indonesia constitution of 1945 article 33, and adjust to the political situation of Indonesia.
