Abstract

Indonesia does not has the adequate capability in surveillance the sea territory. That makes the chance for the foreign fisherman to stealth the fishes in Indonesia sea territory became big. UNCLOS 1982 does not regulate explicitly about drowned the ship that stealth the fishes in Indonesia sea territory. The methods in this thesis used normative research. The data was collected by the used of library research on United Nation on The Law of The Sea (UNCLOS 1982) and fisheries law. The conclusion from this thesis is handling the illegal fishing in Indonesia with drowned the ship by Indonesian government is legal.. Article 73 of UNCLOS 1982 regulate that the coastal state may, in the exercise of its sovereign rights to explore, exploit, conserve and manage the living resources in the exclusive economic zone, take such measures, including boarding, inspection, arrest and judicial proceedings, as may be necessary to ensure compliance with the laws and regulations adopted by it in conformity with UNCLOS 1982.
