Abstract

This thesis, explains what the requirements and problems in licensing when someone will build a building. That to build a building (hotel) in Yogyakarta City one must meet the existing requirements. The obligation of the applicant or the owner of the Hotel Building, in particular to meet administrative requirements, technical requirements and other requirements in accordance with the applicable laws and regulations, as stipulated in the Yogyakarta City Local Regulation No. 2 of 2012 on the Building. One of them is the obligation to have a document in the form of Building Construction Permit (IMB). The formulation of the problem of this thesis is how law enforcement against violations of the provisions of building permits and what are the obstacles and efforts made in enforcing the law against violations of building permit requirements.This thesis uses normative research methods, because in fact there are still many parties who violate the provisions of Building Permit, although already given sanctions. The sanctions given do not provide deterrent effect for violators. So far the obstacles in upholding the law that permit applicant lies, which is difficult to meet the existing requirements due to factors lack of understanding, want quick results and others. If the law enforcement officers are limited personnel who assist in enforcing the law in the field. For applicants the permit should be more careful in meeting the requirements. For law enforcement officers should be more assertive in applying sanctions for violators
