Abstract

The problem of this legal writing is about Indonesian Citizens whom overstayed in Saudi Arabia. The purpose of this research is to determine the role of Indonesian Diplomatic Representative in protecting overstay Indonesian citizens in Saudi Arabia. A normative method was used for this research. Normative method focuses on the positive legal norms of laws. Article 3 of the 1961 Vienna Convention on Diplomatic Relations is about the functions of diplomatic mission. Then, Indonesian Diplomatic mission have the obligation to protect indonesian citizen whom overstayed in Saudi Arabia based on the functions of diplomatic mission. There were many efforts that had been done by Indonesian Diplomatic Mission such as arranged the travel documents. The travel documents are passport, SPLP, and exit permit. As the result, Indonesian Diplomatic Mission has protected the overstaying indonesian citizen in Saudi Arabia in line as mandated by Article 3 of the Vienna Convention 1961, and remains within the boundaries of International Law.
