Abstract

Indonesia is an archipelago nations which consists about 17,500 islands with a coastline approximately 81,000 km. This makes Indonesia as a country with a geographical condition that most of its territory is a coastal area. Coastal area is a strategic area that attracts tourists to be visited, this phenomenon makes the beach area as a place of development of tourism facilities such as hotels and restaurant. One of the island that has many beaches is Bali. In Bali, there is a beach known as Lovina beach. The construction of hotels and restaurants in the Lovina beach border area on the one hand is indeed improving the living standards and the absorbing labor from the surrounding community. However, there is also a negative impact of its construction, that is the disruption of the function of the surrounding community, because the coastal border that is supposed to preserve and sanctity of the beach cannot be used as it should be. The topics taken in this study on the implementation of the provisions of the construction of buildings in the spaces of Lovina beach and the factors that hinder the implementation of the provisions of the construction of buildings in the coastal area Lovina. This research uses empirical law which supported by primary data and secondary data. Primary data is the direct data which obtained from respondents about the object that being studied by interviewing the respondent. However, secondary data is the form of data which obtained indirectly and this data consists of regulation of legislation, expert opinion, book, and from research result. The primary tool data collection is using interviews. The population in this study are all the owners of restaurants and hotels in Lovina beach border area, while the samples from this study are the owners of restaurants and hotels and the samples were selected using random sampling method. Meanwhile, respondents are the owners of hotels and restaurants in Lovina beach border area and the sources of this research are Head of BPN Buleleng, Head of Bapeda Buleleng and Head of Villages. This research uses descriptive research with qualitative type. The study is descriptive with depth description about the situation or process that being study. The method of thinking used in this research is the method of inductive thinking. The method of thinking used in this study is the method of inductive thinking. The method of inductive thinking is the method used in thinking by departing from the specific to general. The conclusion is that Buleleng Government is expected to be firm against the construction development of hotels and restaurants that violate the provisions of Regulation No. 9 of 2013
