Abstract

In the Procince of Papua Human Resource (HR) are still an issued although there are many bachelors and doctorate. This is caused by the lack of proper education for the people of papua. In this case this is lack of the attention of the papuan government, especiallly the goverment of Biak Numfor. The education issue is not only seen from the lack of facilities that supported teaching and learning activities. But also there is no BOS funds that should be accepted by the community, no home for teacher, or any teachers who left their responsibility. This study aims to determine the fulfillment of the rights of the children on basic education in Biak Numfor and as one of the requirements to obtain a law degree at Faculty of Law in Atama Jaya Yogyakarta University. The data used are primary dara consisting of UU 21/2001 about Special Goverment for Papua Province, UU 35/2002 about rebuild of UU 23/2002 about Preservation of Child and secondary data consisting of books, journals, internet references. Role of The local goverment in Biak Numfor are still carrying out its duty has been running well. However there are still constraints of the implementation in local goverment programs and BOS funds.
