Abstract

The development of humans made transportation more advanced from time to time as well as technology. In this modern society, the phenomenon of online-based public transportation has emerged which uses handphone applications as the main media for ordering like "ojek online" motorcycle used for public transport. This is certainly interesting because it raises new problems in traffic. The research is entitle "law enforcement against traffic violations of the use of handphone when riding a motorcycle is done by the driver ojek online”, has a formulation of the problem of how to enforce the law against traffic violations and what are the obstacles faced by the police in enforcing them. The purpose of this study is to obtain data on law enforcement and constraints in enforcing the law. This study uses normative legal research methods that are conducted or focused on positive legal norms in the form of legislation. The data sources used are primary legal material and secondary legal material. Based on the data analysis, it was concluded that law enforcement for "ojek online" drivers who use handphone while driving has not been applied, this of course makes the traffic violators more rampant and disrupt driving activities, endanger the safety of others and themselves.
