Abstract

Yogyakarta is one of the provinces in Indonesia that has problems about fiduciary. Where debtors default and it is difficult to execute fiduciary collateral objects. So that the debtor needs police security in carrying out the execution. The problem of this study was to find out the role and obstacles the police in the implementation of security for the execution of fiduciary guarantees in Yogyakarta. this research uses empirical research methods. The empirical research method is oriented to primary data. An empirical research approach through direct research with interview. After analyze, the role of the Police in assisting creditors is to secure fiduciary execution. When securing execution, the police experience obstacles, one of the obstacles when the debtor moves the object of fiduciary collateral, thus making the process of securing fiduciary guarantee execution hampered and long.
