Abstract

The purpose of this research is to understand what is the Implementation of the WTO Agreement and policy of the subsidized. In this case, China is using subsidy on the solar panel product and the U.S gets an impact of the subsidized. The thesis used normative legal research and the data was collected by library research, and the data were analyzed by deductive methods to find out how the implementations of the WTO Agreement applied and from the research will obtain how WTO work as an organization by the Panel and as an International Law. From the research it is known, China using subsidized on the solar panel product and in this case the U.S using countervailing duty policy as a counter but U.S failed the WTO law cause U.S used it in the wrong way, actions that taken by China and U.S make a hold at WTO implementations and the will of WTO, because they breaking WTO rules on SCM Agreement.
