Abstract

This thesis entitled “Criminal Liability in a Traffic Accident due to a Damaged Road”. The main problem in this thesis is which parties should be criminally responsible for traffic accidents due to road damage. In several, places road damage has never been repaired then it caused many traffic accidents that result in casualties. The purpose of this study is to formulate which parties could be criminally responsible for traffic accidents due to damage roads that have never been completed before. This research is normative legal research, which focuses on positive legal norms in the form of legal regulations. This study requires secondary data consisting of primary data and secondary data obtained from literature studies, which the data is processed using qualitative analysis methods. Furthermore, deductive thinking methods are used to draw conclusions. The conclusion of the methods above that considered the government that had responsible for casesof traffic accidents due to the damaged roads according to the legal regulations.
